General Terms and Conditions

 

1. General

We ask you to carefully read the following travel conditions, which govern the legal relationship between you (hereinafter referred to as the contracting party -VP-) and Helikon-Events GmbH (hereinafter referred to as Helikon or tour operator). With your signature to our written offer these conditions are fully recognized.

2. Conclusion of the travel contract, data protection, signature
The VP data collected in connection with the journey will be stored by us and used exclusively for the purpose of carrying out the journey and for customer support by Helikon and its sister company Schulfahrten Service Büro. The data will not be passed on to third parties who are not entrusted with the execution of the trip. You are entitled to receive information about the stored data at any time and to demand deletion of your data after the end of the trip. Please submit the request for deletion in writing.

3. Payment
The term of payment depends on the performance of your booking.
For accommodation and transfer costs we request a deposit of 50% of the total costs up to 12 weeks before arrival. The deposit will be deducted from the tour price. The balance of the tour price is due 30 days before the start of the tour. In the case of program costs, we also request payment of the total costs 30 days before arrival.
For bookings made less than 30 days prior to departure, the full travel price is due for payment immediately upon receipt of the written travel confirmation. If the prerequisites for the due date of the travel price are fulfilled, the CP shall not be entitled to claim the provision of the travel service by Helikon without complete payment. Helikon is entitled to refuse the services definitively and to demand compensation from the CP for non-performance of the travel contract if the latter is in default of payment of the travel price and the refusal to provide the services has been reminded in writing beforehand, setting a reasonable period of grace.

4. Our Services
The scope of the contractual services depends on our service description and the booking confirmation. They are supplemented by travel documents and general information. Additional agreements, special arrangements and additional requests must be included in the travel registration and confirmed by the travel confirmation in order to become effective. If it results from the aforementioned description of services that individual services of third parties are only mediated, they shall provide the service(s) on their own responsibility.

5. Changes in Services and Prices
1.) Changes or deviations of individual travel services from the agreed content of the travel contract, which become necessary after conclusion of the contract and which were not brought about by the tour operator against good faith, are only permitted if the changes or deviations are not substantial and do not affect the overall layout of the booked trip.
2.) We reserve the right to increase the advertised travel prices confirmed with the booking if, unforeseeably for us after the conclusion of the contract, the following price components increase or arise due to circumstances for which we are not responsible, e.g. entrance fees, transport costs. The price increases are only permissible if there are more than four months between the conclusion of the contract and the travel date. The travel price may only be increased to the extent that this corresponds to the increase in the aforementioned price components since conclusion of the contract and their effect on the costs of the trip per person. In the event of a subsequent change in the tour price or a change in an essential travel service, you will be informed of this immediately after becoming aware of the reason for the change, but no later than 21 days before the start of the tour. Price increases after this date are not permitted. In the event of price increases of more than 5 % or significant changes to a major travel service after conclusion of the contract, you shall be entitled to demand the participation of an equivalent service if Helikon is in a position to offer such a service at no extra charge. Furthermore, you are entitled to cancel the changed service without any charges. The request for an equivalent travel service and the right to withdraw from the contract must be made in writing immediately upon receipt of the notification of change or the price increase.

6. Withdrawal by the VP
You can withdraw from the travel contract at any time before the start of the journey. You must inform us in writing of the withdrawal. The postmark of your written cancellation is decisive. If the SSB incurs cancellation costs vis-à-vis third parties due to the withdrawal of the contractual partner, these must be borne in full by the contractual partner.
